The National Industrial Court’s judgement ordering the professors on strike to return to work was overturned by the appellate court after the ASUU requested permission to challenge the decision.
The court also gave ASUU “conditional leave to appeal the Industrial Court’s order, but insisted that ASUU must comply with the lower court’s order beginning today, October 7.”
The three-person panel, presided over by Justice Hamman Barka, ruled that ASUU must provide proof that its members have resumed work in order to file its notice of appeal within seven days.
The panel held that failure to implement the order, will make the appeal incompetent before Court of Appeal.
